Terms of Service

Conversaix is a hosted platform that helps a business manage leads, customers, messaging, reporting and AI assisted workflows. We may add, change or remove features. If we remove something you rely on, we will give you notice first.

• You must be at least 18 and authorised to act for the business you sign up for.
• Keep your credentials secret. You are responsible for what happens under your logins.
• Give us accurate information and keep it current.
• Tell us right away at admin@adkivity.com if you think an account has been compromised.

You own the data you put into Conversaix. You give us the permission we need to host it, process it and show it back to you and your team. We handle it as described in our Privacy Policy. You can export your data at any time while your account is active.

• Message anyone who has not consented to hear from you, or send anything that breaks the TCPA, CAN SPAM or carrier rules.
• Upload malware, or try to break, probe or overload the service.
• Try to reach another customer's data, or get around account scoping and permissions.
• Resell or white label the service without a written agreement from us.
• Use the AI features to produce anything illegal, deceptive or harassing.
• Scrape the product or use it to build a competing product.

You are responsible for having consent for every contact you load into Conversaix and for every message you send. If we get a complaint or a carrier flags your traffic, we may pause your sending while we look into it.

Conversaix is an operating system, not a Do Not Call or list scrubbing service. We are not responsible for the accuracy, ownership or consent status of the data you message, email or text through the platform.

By sending any message from Conversaix you confirm that you or your company own the data, and that you have verified you are permitted to contact those people, by that channel, during legally allowable hours, under the TCPA, CAN SPAM, and all applicable state and federal Do Not Call rules. Maintaining consent, opt outs and suppression lists is your responsibility, and yours to prove.

Adkivity LLC is not responsible for any text, email or other message sent from the platform. That liability rests with you.

Conversaix drafts messages, summaries and recommendations using AI. AI output can be wrong. Nothing goes to a customer, gets published, or spends ad budget without a person on your team approving it. You are responsible for reviewing what you approve.

Usage limits apply to AI features and are shown in the product. We may adjust them to keep costs sane, and we will tell you when we do.

When you connect Google, Meta, GoHighLevel or another service, you are also bound by that provider's terms. We are not responsible for their outages, policy changes or decisions to cut off access.

• Fees are what you agreed to at signup or in your order form.
• Subscriptions renew automatically until you cancel.
• Payment is due when invoiced. Late accounts may be suspended.
• Fees are non refundable except where the law requires a refund.
• We will give you at least 30 days notice before a price change.

You can cancel at any time and your access runs to the end of the paid period. We can suspend or end your account if you break these terms, do not pay, or put the service or another customer at risk. After termination you have 30 days to export your data, then we delete it as described in the Privacy Policy.

The service is provided as is. We do not promise it will be uninterrupted or error free. To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non infringement.

To the extent the law allows, neither party is liable for indirect, incidental or consequential damages, or for lost profits or lost data. Our total liability for any claim is capped at what you paid us in the 12 months before the claim.

You will defend and cover us against claims arising from your data, your messaging, or your use of the service in a way these terms do not allow.

We may update these terms. We will post the new version here and update the effective date. For material changes we will email account owners at least 30 days before they take effect. Continuing to use the service after that means you accept the new terms.

These terms are governed by the laws of the State of Florida, without regard to its conflict of laws rules. Disputes go to the state or federal courts located in Orange County, Florida, and both parties consent to that jurisdiction.
